Terms of Service

Welcome to Partfully. Partfully is a product of CBH Labs LLC, a California limited liability company ("CBH Labs," "we," "our," or "us"). By accessing or using the Partfully application ("App"), website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms are a binding agreement between you and CBH Labs LLC. CBH Labs LLC is the operator of the Service and the party contracting with you.

1. Description of the Service

Partfully is an AI-powered companion for personal self-exploration inspired by Internal Family Systems (IFS) practices. The Service provides guided voice sessions, text-based conversations, guided meditations, a parts-mapping tool, a session journal, and journey insights.

Partfully is not a medical device, licensed therapist, or healthcare provider. The Service does not provide medical, psychological, or therapeutic advice and is not a substitute for professional mental health care. The Service is intended for adults engaging in personal self-exploration. It is not designed for use in clinical, diagnostic, or emergency contexts. If you are in crisis or need clinical support, please contact a qualified professional or emergency services immediately.

CBH Labs is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). The information you share with the Service is not protected health information (PHI) under HIPAA. While we take data security seriously (see our Privacy Policy), the protections afforded by HIPAA do not apply to data processed by the Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old. If you are under 18, you may not use the Service.

3. Accounts

You may use certain features of the Service without creating an account (as an anonymous user). To access your session journal, parts map, and journey insights, you must sign in using one of the available methods: Google Sign-In, Apple Sign-In, or email and password, each managed through Firebase Authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Subscriptions and Payments

Partfully offers a limited number of free sessions. Unlimited access requires a paid subscription.

Pricing: Subscriptions are available on a monthly or annual basis at the prices displayed in the App at the time of purchase.
Billing: On iOS and Android, payments are processed through Apple's App Store or Google Play, and your Apple ID or Google account is charged at confirmation of purchase. Where a subscription is purchased on the web, payment is processed by our subscription provider and its payment processor. CBH Labs does not receive or store your card number.
Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Cancellation: You may cancel your subscription at any time through your device's subscription settings (Settings > Subscriptions on iOS, or Google Play > Subscriptions on Android), or through the management link in Settings for a web subscription. Cancellation takes effect at the end of the current billing period; no partial refunds are provided.
Refunds: For purchases made through the App Store or Google Play, refund requests are handled by Apple or Google in accordance with their respective refund policies. For web purchases, contact [email protected].
Deleting your account does not cancel billing. If you delete your Partfully account while a subscription is active, you must also cancel the subscription through the store or provider that bills you.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law.
Attempt to reverse-engineer, decompile, or extract source code from the App.
Interfere with or disrupt the Service or its infrastructure.
Use the Service to harm, harass, or exploit others.
Misrepresent the Service as a substitute for professional therapy or medical advice.

6. AI-Generated Content

The Service uses artificial intelligence to generate conversational responses, session notes, insights, and audio narration. AI-generated content may be inaccurate, incomplete, or inappropriate. You acknowledge that:

AI responses are generated algorithmically and do not constitute professional advice of any kind.
You should not rely on AI-generated content for medical, psychological, legal, or financial decisions.
CBH Labs does not guarantee the accuracy, reliability, or suitability of any AI-generated content, and AI output must not be relied on for any medical, clinical, legal, financial, or other regulated decision.
You assume all risk associated with your use of AI-generated content. The Service may produce responses that are emotionally activating; you are responsible for managing your own wellbeing and seeking professional support when needed.

7. Your Content

You retain ownership of any content you create through the Service, including journal entries, session transcripts, observations, and parts-map data ("Your Content"). By using the Service, you grant CBH Labs a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete your account.

CBH Labs does not use Your Content to train, fine-tune, or improve any machine learning model. We do not train models of our own, and we do not supply Your Content to anyone for model training.

To generate responses, Your Content is sent to the third-party AI providers identified in our Privacy Policy. We access those providers through their commercial APIs and rely on the data-use terms those APIs provide. Those providers control their own systems, and we cannot make guarantees on their behalf. Review their policies if this matters to you.

8. Intellectual Property

The Service, including its design, code, branding, and original content, is owned by CBH Labs LLC and protected by applicable intellectual property laws. These Terms do not grant you any right to use the Partfully name, logo, or other brand features.

Internal Family Systems and IFS are trademarks of the IFS Institute. Partfully and CBH Labs LLC are not affiliated with, endorsed by, or licensed by the IFS Institute or Dr. Richard Schwartz.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. CBH Labs does not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, CBH Labs LLC and its members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, emotional distress, or loss of profits, arising out of or in connection with your use of the Service.

Without limiting the foregoing, CBH Labs expressly disclaims liability for any emotional distress, psychological harm, or worsening of mental health conditions arising from your use of the Service.

In no event shall CBH Labs' total liability exceed the amount you have paid to CBH Labs for the Service in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CBH Labs LLC from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time from Settings → Delete Account in the App. Deletion is immediate and permanent; see our Privacy Policy for what is removed. You may also contact [email protected] for help with deletion.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means, and we will ask you to re-accept the updated Terms before continuing to use the Service. The "Effective date" at the top of this page indicates when the Terms were last revised.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

15. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

You and CBH Labs LLC agree to resolve any disputes arising out of or relating to these Terms or the Service through final and binding individual arbitration, rather than in court, except as set forth below.

Arbitration rules: Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will be conducted in English and held in Santa Clara County, California, or remotely at your election.
Individual basis only: All claims must be brought in your individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Small claims exception: Either party may bring an individual action in small claims court if the claim qualifies.
Injunctive relief exception: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Opt-out right: You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Santa Clara County, California.

16. Force Majeure

CBH Labs shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, failures of third-party service providers (such as AI or cloud hosting providers), pandemics, or other force majeure events.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CBH Labs LLC regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
